Experienced Defense Attorney Awaits

At Correa & Martinez Trial Lawyers, our criminal defense lawyer is a former Assistant State Attorney with a breadth of experience on both sides of the aisle. Your case will be given the full attention of your attorney, who will evaluate the case against you to discover any flaw that can be exploited to achieve a positive result, whether a dismissed charge, reduced charge, or an acquittal at trial.

Types of fraud charges in Miami

Fraud charges may be filed in either state or federal court or both. The types of fraud charges our firm defends include but are not limited to:

  • Credit card fraud: Credit card fraud involves the unauthorized use of someone else’s credit card information to make purchases or withdraw funds.
  • Bankruptcy fraud: Bankruptcy fraud cases involve an attempt to conceal assets or to submit false information to the bankruptcy court.
  • Identity theft: Identity theft involves the use of another party’s personal information for financial benefit.
  • Insurance fraud: Insurance fraud often involves misrepresenting information on insurance claims.
  • Wire fraud: This federal crime involves the use of electronic communications to defraud individuals or entities.
  • Mail fraud: Mail fraud is a federal offense filed if it is alleged that the accused used the postal system for a fraud scheme.
  • Health care fraud: These crimes involve fraudulent insurance billing, or the misrepresentation of medical services provided to a patient.
  • Mortgage fraud: involves lying or omitting information on a mortgage application, such as your income or other assets, to obtain approval. In some cases, the charges are filed against a mortgage lender or other party involved in the mortgage industry.
  • RICO charges (Racketeer Influenced and Corrupt Organizations Act): These crimes are considered organized criminal activities and cover a range of very serious federal crimes.

The elements of fraud: What the prosecutor must prove in a fraud case

The burden of proof in a fraud case lies with the prosecuting attorney. All of the following elements must be proven beyond a reasonable doubt to secure a conviction:

Intent to deceive

It must be proven that the accused had the intention to deceive or defraud another party.

False representation or concealment

The case must include a false statement, representation, or concealment of material facts by the defendant. These statements could be in several forms, including verbal statements, written documents, or omissions of important facts.

It must be proven that another person or entity relied on false representation or concealment and, in so doing, experienced financial or other losses.

The false statement or concealment must be material, meaning that it is significant enough to influence the decisions or actions of the alleged victim.

Harm or loss

The alleged victim must prove that actual harm or financial loss occurred due to the actions of the accused. The types of harm can include monetary losses, reputation damage, or even emotional damage.

A direct causal link must be established between the alleged fraudulent conduct and the harm suffered by the victim and proven to be the primary cause of the harm.
